Applicable Federal Rules

Overview

This tool is a quick reference item to allow you to view the following Federal Rules that have been identified as applicable for your facility thus far: MACT, NSPS, NESHAPs, PSD, NSR, 112(r), or Title IV. If the box is checked then your facility has been determined to be subject to that category. Subheadings for each of the Federal Rules will be displayed under the Federal Rules Applicability section that identifies applicable subparts and/or pollutants for each applicable Federal Rule.

Identifying Federal Rules as Applicable

Owners or operators applying for a PTI or PTIO air permit designate in the application, whether submitted electronically or in hard copy form (option for non-Title V facilities), if certain Federal Rules apply. If a Federal Rule has been identified as applicable in an application submitted electronically by the applicant, or entered electronically by Ohio EPA staff for hard copy applications submitted, it will be automatically incorporated in the Federal Rules Applicability section.

Changes to the Applicability of Federal Rules, Subparts or Pollutants

With each application submittal, the Federal Rules Applicability section is automatically updated. Ohio EPA staff also have the ability to make changes to the Federal Rules Applicability section based upon a review of your application without requiring the need for you to submit an amended or new application.

If an owner or operator identifies that a change is needed to the Federal Rules Applicability section, but believes the change does not result in the need for an application, Ohio EPA staff have the ability to make changes.

If you review the rule and determine that your facility is no longer subject to the rule, or if your facility is now subject to an additional Federal Rule, subpart or pollutant, you can notify your local District Office or Local Air Agency to request changes to the Federal Rules Applicability section and determine any necessary next steps.
